When outlining legislative powers the Founders arguably gave much leeway to Congress. Under the necessary and proper clause, Congress is given much discretion and power when compared to the other branches of governments in creating the means to achieve its ends. Many, including the Founders, were concerned that this discretion could be abused and widened without much in the way to stop it.
Given the cases we have read, do you believe this has happened? Has congressional power been abused and widened too much under the necessary and proper clause? What cases support your conclusion?
