Topic:
In most states and cities throughout the United States, the government does not require that employers have to provide paid sick days off to their employees. So what we typically see is that, many companies offer paid sick days off to their employees who earn salaries but not to employees who work on an hourly-wage basis. Some argue that companies should offer ALL employees paid sick time off to decrease the number of individuals coming to work sick– particularly as we continue to deal with the pandemic. Question: Let’s say the bill requiring employers to provide paid sick leave passes in Congress and is signed into law by the President. Immediately, several states sue the federal government claiming that the federal government has overstepped its authority. Would the arguments of this case be most likely heard in the individual state courts or in a federal court? Why?
If this case makes it all the way to the U.S. Supreme Court, would we expect the court to rule in favor of or against the federal government? Explain your logic. (Knowing whether the court currently has a conservative or liberal majority will help you answer this.) Finally, name one interest group that might file an amicus curiae with the court either in support of or against this new law, and state why this interest group cares about this issue.
