Noreen wanted to learn to drive and started taking lessons from Robert, a qualified driving instructor. On her second lesson, Noreen failed to stop at a red light at a crossing and she ran into Charles’s car. Both Robert’s and Charles’s cars were damaged badly, and Robert broke an arm and hit his head against dashboard of the cat Noreen suffered no injuries. Charles suffered a major spinal injury and was so traumatised by the accident, that he also developed post-traumatic stress disorder (PTSD). Due to his injuries and the PTSD he could not run his business for over a year after the accident.
The accident happened just after Charles had dropped his wife Sharon off at the library. Sharon heard the crash, ran to the scene of the accident and saw Charles bleeding in the wreck of his car.
As a result of what she saw, she developed serious depression and also had to stop working for six months. Sharon and Charles, both being out of work, could not afford paying their mortgage and lost their house as a result.
Discuss all possible claims in negligence arising from this scenario.
