Assignments for Week #7 – Media Production Contracts Read the textbook and documents as instructed below and answer the ten questions in red below.
Read Chapter 13 in the textbook. Note that the text in Chapter 13 talks about book authors because they constitute the main audience for which the book is intended. But most of the principles that apply to authors apply with equal force to any creative person (“creative” for short) who is assigning or licensing intellectual property rights in his/her work product to anotherparty. Answer the following questions:
– Why is it necessary and customary for a creative to make representations and warranties about the work product being provided pursuant to an assignment or a license?
– What is the difference between a representation and a warranty?
– What is the difference between plagiarism and copyright infringement? (Hint – you can find the answer in Chapter 13, but also in Chapter 1)?
– What does an indemnity provision typically include? Why is it unfair to ask a creative to indemnify for an alleged breach of the representations and warranties?
