In England and Wales, there is generally no liability for omissions unless there is a duty to act. As there is also no general duty to act, there is no obligation to help citizens who are in danger. i.e. there is no “Good Samaritan” law.
Do you think or not that there should be such a law in England and Wales? Is there an alternative basis upon which omissions liability could be based?
Use cases to explain your reasoning.
