International Law of the Sale of Goods
Task:
Pandemico Ltd (the seller) agrees to sell vaccines for Covid 19 on “fob” terms to , Health Care Provident (the buyer) a company based in Brazil. Shipment is scheduled for April 2021 fob Liverpool. The following email was received from the buyer on 7 March “We intend to nominate The Johnson which will be entering port on 13 March 2021. Ship will be ready to load on 15 April”.
Owing to an oversight of an employee of Pandemico (the seller) the email was not brought to the attention of Pandemico (the seller) until the 14th April.
It is uncertain if normal loading rate (specified in the contract) will enable completion of loading before the expiry of the shipment period.
In the interim the goods are kept in a warehouse in Manchester. On 14 April a massive strike was called by rail workers which paralysed the rail network.
Requirement:
