Question 1
Najet is a keen botanist and her ambition is to develop a botanical garden where she can cultivate rare orchids. During her postgraduate studies Najet specialised in the cultivation of the Yellow Lady’s Slipper orchid, a very rare type which takes around six-to-11 years to mature and produce a flower. To fulfil her ambition Najet has recently purchased a 25 acre estate located on the outskirts of the city centre. The land was previously used as a private school but was closed in the 1980s. The old school building on the land is derelict and there is an eight-foot tall fence surrounding the perimeter of the 25 acres.
Najet has acquired the appropriate planning permission to use the land as a botanical garden. She has employed an architect, Alice, who has designed the large greenhouse which will house a number of exotic plants, including the Yellow Lady’s Slipper. Alongside this building work the surrounding sections of the land will be developed in order to create a range of gardens and country walks.
Adjacent to this building work is an agricultural farm which produces a range of crops such as cabbages, potatoes, carrots, parsnips and cauliflowers. In addition to the cultivation of crops the farm houses 50 Goldline Hybrid chickens. These chickens have been laying around 300 to 350 eggs per a week. The farm is owned by Megan who lives in a small cottage on the land. Megan has owned and worked the farm for 25 years.
Najet is keen to start the building work and has asked for it to be completed within three-months. Alice has informed Najet this is possible but the building work will have to be seven-days per week, starting at 7am and finishing at 7pm. With this work schedule in place it is possible to complete the work within three-months. Najet agrees the work schedule and Alice begins knocking down the old school house and landscaping the 25 acres.
The noise and dust from the building work is having an effect on Megan’s farm. Her crops are failing and her chickens have stopped laying eggs. Megan contacts Najet and explains that the constant noise is upsetting her chickens and they are not producing eggs. She explains to Najet that the dust has prevented her crops from growing and she is not able to fulfil her orders for her customers. Najet informs Megan that the work is only short term and will be completed within a three-month period.
The building work is completed on time and has recently opened to the public. Najet has imported some mature Yellow Lady’s Slipper orchids whilst she cultivates her own. It proves to be a popular venue and has drawn large crowds, particularly on the weekends when families visit with their children. Najet has noticed that many of the children wander off on their own whilst the parents admire the Yellow Lady’s Slipper orchid. To remind parents to keep a watchful eye on their children she places a large notice at the entrance to the botanical garden which states: ‘Children must be accompanied by responsible adults at all times. No responsibility can be accepted for injury or damage suffered while on these premises’.
Franco and his wife Carmella take their children, Mateo, aged seven, and Greta, aged four, for a day trip to the botanic garden. Franco and Carmella wish to see the Yellow Lady’s Slipper orchids. Whilst inside the greenhouse Franco and Carmella are admiring the orchids but Mateo and Greta become bored and wander off. The two children come across the herb garden. In this garden is a bush with bright red berries. In front of the bush is a notice which states that the berries are poisonous and should not be eaten. There is also a small fence around this bush which Greta is able to step over. Greta eats some of the berries and feels ill. Mateo decides to look for his mother and father, as he is worried about Greta. He becomes lost and enters a room which has a large notice on the door: ‘Private. No admission to the public’. Inside the room are a number of garden tools and a bottle of weed killer. Mateo trips over a lawn-edging tool, cuts his leg and spills the weed killer over the floor. Mateo gets the weed killer solution on his hands whilst getting up off the floor. He subsequently licks his fingers and becomes violently ill. Fortunately, an employee finds Mateo and Greta and seeks immediate medical assistance.
Advise Najet of any potential liability she owes towards Megan, Mateo and Greta.

Reflective Learning
This section of the emTMA is asking you to reflect upon your personal experience on this module. You are being asked to reflect on your learning and identify any developmental points. This requires a personal response as each individual will have a different starting point in their educational journey. For example, whilst undertaking your studies you may have needed to manage your time, your employment, develop existing skills or new skills such as studying online. As this is a personal response there is no prescriptive answer to this section of the emTMA. You are being asked to demonstrate reflective skills by sharing your thoughts on your personal experience whilst studying this module. Whilst reflecting on these experiences you may discuss your personal development, such as how learning has taken place for you. You may discuss how the attributes of certain skills have supported you with your assessment(s). For example, drafting a plan, using in-text referencing and providing a reference list that complies with the required academic structure. These are some of the challenges you were set whilst studying this module.
