2. Decertification elections are gaining interest from employers because they will end the union’s ability to represent workers at elections. It enables workers to request a special election to remove the union as their sole representative, effectively eliminating the union. Because the employees terminated them in the aforementioned election, the employers will no longer bargain with the union. According to the Labor Law, a decertification election revokes the union’s certification by the employees as their sole agent in negotiations.
